Probate Court
Probate Court has many responsibilities. Here you can find birth certificates and death certificates You can obtain marriage and firearm licenses and fireworks and blasting permits
The Probate Court also handles descendant’s estate matters, guardianship (adults and minors), conservatorship (adults and minors) and involuntary intervention for mental illness and substance abuse. In addition, you can contact the Probate Court for traffic and misdemeanor criminal cases.
Magistrate Court
Magistrate Court is for those times that you can’t resolve a dispute with a person or a business, you may take your problem to court. Magistrate Court, also called small claims court, is an informal court that handles money claims of less than $15,000. This court offers a quick and inexpensive process to resolve complaints. You may file a claim in Magistrate Court in your own name without an attorney, or you may hire an attorney at your expense. Magistrate Court cases are heard and decided by a judge without a jury. In some counties, mediation is recommended or required before a judge will hear the case.
The Superior Court
The Superior Court is the State of Georgia’s trial court of general jurisdiction. The Constitution of the State of Georgia gives the Superior Court exclusive original jurisdiction, except when the defendant is a juvenile, in all felony cases as well as cases involving divorce, equity and title to land. The Superior Court also has exclusive jurisdiction in such matters as declaratory judgments, habeas corpus, mandamus, quo warranto, and prohibition. With the exception of certain juvenile and probate matters, the Superior Court also has concurrent jurisdiction with local limited jurisdiction trial courts such as the Magistrate/Civil Court, the Probate Court, the Juvenile Court, and the State Court. Superior Court Judges preside over cases involving misdemeanors, contract disputes, premises liability, and various other actions. In addition, the Superior Court has exclusive equity jurisdiction over all cases of divorce, title to land, and felonies involving jury trials, including death penalty cases.
